The Anti-Money Laundering and Know Your Customer Policy (hereinafter referred to as "AML/KYC Policy") is designed to prevent and mitigate possible risks of Cryptabar being involved in any illegal activities.
The Service adheres to practices and measures in the field of combating money laundering (AML) and terrorist financing. The purpose of these measures is to demonstrate that Cryptabar takes any attempt to use its services for illegal purposes seriously.
Cryptabar warns users against attempting to use the Service for money laundering, terrorist financing, fraud of any kind, or the purchase of prohibited goods and services.
Cryptabar, its administration, staff, and domain owners are not liable for the improper use of the Service by third parties, actions by malicious actors, or any potential damage caused by using the Service.
To prevent illegal transactions, Cryptabar sets specific requirements for all requests created by users:
4.1. The sender and recipient of the payment in the request must be the same person. Transfers to third parties using the Service are strictly prohibited.
4.2. All contact information and personal data provided by the User must be current and entirely accurate.
4.3. It is strictly prohibited to create requests using anonymous proxy servers, VPN, Tor, or any other anonymous Internet connections.
One of the international standards for preventing illegal activities is proper client verification (hereinafter referred to as Verification). To this end, Cryptabar implements its own verification procedures in strict compliance with AML and KYC standards.
5.1. Cryptabar may require the User to provide reliable, independent source documents, data, or information (e.g., a national ID card, an international passport, or a bank statement). For such purposes, Cryptabar reserves the right to collect the User's identification information to comply with the AML/KYC Policy.
5.2. Cryptabar will take steps to verify the authenticity of documents and information provided by Users. All legal methods of double-checking identification information will be used, and the Service reserves the right to investigate cases where certain Users are identified as high-risk or suspicious.
5.3. Cryptabar reserves the right to verify the User's identity on an ongoing basis, especially when their identification information has been changed or their activity appears suspicious (unusual for a specific User). Furthermore, Cryptabar reserves the right to request updated documents from Users, even if they have previously passed identity verification.
5.4. Identification information will be collected, stored, shared, and protected strictly in accordance with Cryptabar's Privacy Policy and applicable regulations.
5.5. After confirming a User's identity, Cryptabar may refuse to provide services if the Service is being used for illegal activities.
5.6. Users who intend to use payment cards for services must verify their cards according to instructions available on the Cryptabar website.
5.7. Cryptabar has regulatory requirements to verify the source of funds or cryptocurrency to ensure that the sources of funds used by Users for transactions are legitimate.
The person responsible for ensuring AML compliance is duly authorized by Cryptabar, whose duty is to ensure the effective implementation and enforcement of the AML/KYC Policy.
6.1. The responsibilities of the Responsible Officer include:
- Collecting identification information from users;
- Creating and updating internal policies and procedures to complete, review, submit, and store all reports and records required under applicable laws and regulations;
- Monitoring transactions and investigating any significant deviations from normal activity;
- Implementing a record management system for proper storage and retrieval of documents, files, forms, and logs;
- Regularly updating risk assessments;
- Providing law enforcement agencies with information required under applicable laws and regulations.
6.2. The Responsible Officer has the authority to interact with law enforcement agencies involved in preventing money laundering, terrorist financing, and other illegal activities.
Cryptabar performs numerous tasks related to compliance, including data collection, filtering, record-keeping, investigation management, and reporting. System functions include:
- Daily checks of Users against recognized "blacklists" (e.g., OFAC), aggregating data from multiple sources, adding Users to watchlists, denying services, opening cases for investigation when necessary, sending internal messages, and filing mandatory reports when applicable;
- Case and document management.
Cryptabar analyzes User behavior in transactions to assess risks and detect suspicious activity. Data analysis is a critical tool for evaluation.
Cryptabar employs risk assessment practices to combat money laundering and terrorist financing. These measures ensure that the level of protection corresponds to the identified risks.
If the Cryptabar administration reasonably suspects that a User is attempting to use the Service for money laundering or any other illegal operations, the administration has the right to:
10.1. Suspend the User's transaction;
10.2. Request identity verification documents from the User;
10.3. Request any additional information and documents from the User in case of suspicious transactions;
10.4. Ensure that reports of suspicious transactions are forwarded to the appropriate law enforcement authorities through the Responsible Officer.
Cryptabar guarantees client confidentiality in accordance with its Privacy Policy.
11.1. Cryptabar and its staff are obligated to maintain confidentiality regarding any facts revealed in connection with any suspicious transactions. This obligation also extends to Users and third parties who were provided information about the transaction.
11.2. The obligation to maintain confidentiality remains in effect even after employees terminate their employment or other contractual relationships with the Service.
11.3. Confidentiality obligations do not apply when disclosing information between financial institutions within a consolidated group to prevent the legitimization of criminal proceeds and terrorist financing.
In light of the above, Cryptabar does not assume any legal responsibility for the use of its Service for money laundering, terrorist financing, or purchasing prohibited goods and services. However, Cryptabar is committed to taking all possible and available actions to prevent attempts to use the Service for illegal purposes.
